Terms of Service
- AbaAiCheck is a decision-support tool that flags documentation gaps. It is not medical, legal or billing advice.
- You remain responsible for the accuracy of your notes and for every billing decision.
- Results can be wrong or incomplete. Always review them with your own clinical judgment.
- You keep ownership of your notes and patient records. We use them only to run the Service for you.
- Use it lawfully, and never to falsify clinical documentation or claims.
1. Agreement to these terms
These Terms of Service (“Terms”) govern your access to and use of AbaAiCheck’s website at abaaicheck.com, web app at app.abaaicheck.com, API and browser extension (together, the “Service”), provided by AbaAiCheck (“AbaAiCheck”, “we”, “us”). By creating an account, installing the extension or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you use the Service on behalf of an organization, you confirm that you have authority to bind it, and “you” includes that organization. If you do not agree, do not use the Service.
2. The Service
AbaAiCheck helps Registered Behavior Technicians (RBTs), Board Certified Behavior Analysts (BCBAs) and ABA agencies review session notes for documentation quality and consistency with the requirements of CPT codes 97153, 97155, 97156 and 97151. It can compare a note with a client’s behavior intervention plan (BIP), break behaviors down into antecedent, topography, interventions and response, and suggest corrections. Results are produced by automated analysis, which may be performed by our own rules engine or, when enabled, with the help of an AI provider. Each result shows which one was used.
The Service does not submit claims, contact payers or change the records in your EHR or any other system. It never edits the text of your notes.
3. Accounts and eligibility
- The Service is for adult professionals and organizations. You must be at least 18 years old and able to enter into a binding contract.
- You may sign in with an email and password or, where offered, with Google. Provide accurate information and keep it up to date.
- Keep your credentials confidential. You are responsible for activity under your account, so tell us promptly if you suspect unauthorized access. Do not share an account between several people.
- Passwords must be at least 8 characters, and sessions expire automatically for your protection. We limit the rate of sign-in and analysis requests to protect the Service.
4. Your content and permissions
“Your Content” means the notes, patient and plan records, documents and other material you submit to the Service. You retain all rights in Your Content. You grant us a limited, worldwide, non-exclusive license to host, process and analyze Your Content solely to provide the Service to you, to keep it secure, and as described in the Privacy Policy. We do not use Your Content to train AI models. Notes you submit for review are analyzed and not stored, as described in the Privacy Policy, unless you choose peer supervision: if you accept a colleague as your supervisor, we keep a read-only history of your reviews (including note text) that only that supervisor can see, until you remove the supervisor, at which point it is deleted. You are responsible for having the authority to share that information with your supervisor. Likewise, if you use the Service under an agency, the agency sees only quality metrics unless you choose to share detailed audit records with it in Settings; you may withdraw that choice at any time.
You represent that you have all rights, consents and authorizations needed to submit Your Content, including any authorization required to use clients’ health information, and that your use of it through the Service complies with applicable law and your obligations to your clients and employer.
5. No professional advice
AbaAiCheck is a decision-support tool. It does not provide medical, clinical, legal, coding, compliance or billing advice, and it does not replace the judgment of a qualified professional.
Automated results may be inaccurate, incomplete or out of date, and payer requirements vary and change. A favorable result (for example, a high score or a “CONSISTENT” status) does not guarantee that a note is accurate, that a service qualifies for a given code, or that a payer will accept or pay a claim. An unfavorable result does not mean a note is wrong. You are solely responsible for the content of your clinical documentation and for the codes you bill.
6. Your responsibilities
- Review every result and decide for yourself what to document, correct or bill.
- Make sure your notes truthfully reflect the services that were actually provided.
- Follow the laws, payer rules, professional standards and employer policies that apply to you.
- Submit only the information you need. Where possible, avoid direct identifiers in notes you send for review.
7. Acceptable use
You agree not to, and not to help anyone else to:
- use the Service unlawfully, or to create, alter or submit false, misleading or fraudulent clinical documentation or claims, including using results to make a note appear to describe services that did not occur;
- access accounts, records or data that are not yours, or attempt to bypass access controls, rate limits or other security measures;
- probe, scan or test the vulnerability of the Service, or interfere with or overload it, without our prior written permission;
- reverse engineer, decompile or copy the Service, or resell or provide access to it to third parties, except as the law allows or we agree in writing;
- use bots, scrapers or other automated means to access the Service other than through interfaces we provide for that purpose;
- upload malware, or submit content you have no right to submit; or
- use the Service in a way that violates the rights of others.
8. Health information and HIPAA
The Service is designed with technical safeguards suited to sensitive information, such as encryption in transit and at rest, but we do not claim any certification, and whether your use of the Service complies with HIPAA or other laws depends on your own practices and agreements. If you are a covered entity or business associate and need a Business Associate Agreement (BAA), contact us before submitting protected health information. Nothing in these Terms is a BAA. Please read our Privacy Policy for how information is handled.
9. The browser extension
The extension is part of the Service and is subject to these Terms and to the terms of the store from which you install it. It reads the current page only when you click its icon and press the capture button, and never modifies the page. You are responsible for making sure that capturing text from a given website is permitted by that site’s owner, your employer and applicable law. The extension may update automatically through the browser’s store.
10. Third-party services
The Service relies on third parties such as hosting and network providers, Google (if you choose to sign in with Google) and, when AI analysis is enabled, an AI provider such as Anthropic. Their services are subject to their own terms and privacy policies, and we are not responsible for them. The Service may also link to third-party sites.
11. Intellectual property
The Service, including its software, design, text, logos and the analysis rules, belongs to AbaAiCheck or its licensors and is protected by law. We grant you a limited, revocable, non-exclusive, non-transferable right to use the Service for your professional purposes in accordance with these Terms. If you send us feedback or suggestions, you allow us to use them without restriction or compensation.
12. Early access and fees
The Service is currently offered as an early-access product and is free to try, with no credit card required. Features may change, be limited or be removed. If we introduce paid plans, we will tell you in advance, and you will not be charged unless you agree to a paid plan.
13. Suspension and termination
You may stop using the Service at any time, and you can ask us to delete your account (see the Privacy Policy). We may suspend or terminate your access, immediately when needed, if you breach these Terms, if your use creates a security or legal risk, or if we discontinue the Service. When an account is suspended, its sessions stop working. After termination, the sections of these Terms that by their nature should survive will continue to apply, including sections 5, 14, 15, 16 and 18.
14. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including warranties of accuracy, merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free or secure, that results will be accurate or complete, or that any claim will be accepted or paid.
15. Limitation of liability
To the fullest extent permitted by law, AbaAiCheck and its owners, personnel and licensors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, or for claim denials, recoupments, audit findings or penalties, arising out of or related to the Service, even if advised of the possibility of such damages. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the 12 months before the claim or US$100.
Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.
16. Indemnification
You will defend and indemnify AbaAiCheck against third-party claims, and related losses and reasonable costs, arising from Your Content, your breach of these Terms or applicable law, or your clinical documentation and billing decisions, except to the extent caused by our own breach of these Terms.
17. Changes to the Service or terms
We may modify the Service and these Terms. We will update the date at the top and, for material changes, give notice in the app or by email before they take effect. If you keep using the Service after the changes take effect, you accept them. If you do not agree, stop using the Service.
18. General
These Terms and the Privacy Policy are the entire agreement between you and us about the Service. If a provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. Before starting any formal dispute, please contact us so we can try to resolve it informally.
